The coroner has backed the decision not to prosecute retailer Tony Singh over the death of an armed robber outside his store.
Convicted robber Liam Kilroe died from a stab wound to the chest after attempting to rob Tony earlier in the year (C-Store, March 7, 2008).
Tony had been carrying £2,000 in takings from his Lifestyle Express store in Skelmersdale, Lancashire, when Kilroe launched the attack, smashing the retailer's car window and threatening him with a knife. At some point during the violent struggle Kilroe was stabbed with his own blade. Tony sustained knife wounds to his face, neck and back, and was bitten.
A post-mortem showed that Kilroe had high levels of cocaine in his bloodstream.
Lawyers for Kilroe's mother had asked the Lancashire coroner to consider a verdict of unlawful killing, despite an earlier decision by the Crown Prosecution Service not to press charges against the retailer.
A verdict of death by misadventure was recorded.
